Terms of Use

This User Agreement is an electronic record governed by the Information Technology Act, 2000 (“Act”), including applicable rules and amendments such as the Information Technology (Amendment) Act, 2008. It is generated electronically and does not require any physical or digital signatures.

 

This Agreement is published in compliance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which mandates the publication of rules, regulations, privacy policy, and terms and conditions for accessing and/or using the website www.agramkonnect.com (“Website”).

 

In this Agreement, the following terms have the meanings given below:

  • “User” means any individual visiting, accessing, or using the Website via any communication device

  • “Agram Konnect” refers to Agram Marketing and Services Pvt Ltd, the rightful owner of the Website

  • References to “You” or “Your” mean the User, and references to “We”, “Us”, “Our”, or “Agram Marketing” mean Agram Konnect.

 

This is a legally binding agreement between You (the User) and Agram Konnect, establishing the terms that govern Your use of the Website. By accessing or using the Website, You agree to comply fully with these Terms of Use. If You do not agree to these Terms, You must not access or use the Website, as any further use will be unauthorised.

 

Your access and use of the Website signify Your acceptance of these binding Terms of Use. This Agreement, including the Privacy Policy available on the Website, constitutes the entire understanding between You and Agram Konnect regarding use of the Website. Agram Konnect also reserves the right to deny or restrict access to all or any part of the Website to anyone We reasonably believe has violated these Terms of Use.

1. Access to the Website

    • Access to the Website is strictly limited to Users who are at least 18 years old, or 21 years old if a guardian is appointed according to the Majority Act, 1875 (“Age of Majority”).

    • If You are under the Age of Majority and continue to access the Website, it will be assumed that You have reviewed these Terms and the Privacy Policy with Your parent or legal guardian, and that they consent to Your access and use of the Website on Your behalf. Your use of the Website is subject to such parental or guardian supervision and consent at all times.

    • Agram Konnect grants You a personal, revocable, non-exclusive, non-transferable license to access and use the Website strictly for private, non-commercial purposes in accordance with these Terms. These Terms govern Your access to and use of the Website and any content You upload, publish, share, or transmit on it.

    • Website availability and Your ability to access it may be restricted by Agram Konnect at Our discretion based on Your geographic location. You agree to comply with all applicable laws and acknowledge that Your access may be affected by jurisdiction, device type, internet connection, and related factors. You are solely responsible for any equipment, data, or service fees necessary to access the Website.

2. Ownership of Intellectual Property Rights

    • “Intellectual Property Rights” means all patents, copyrights, trademarks, service marks, trade names, design rights, trade secrets, database rights, and similar proprietary rights owned or licensed by Agram Konnect, whether registered or not, including all applications and renewals thereof.

    • You agree not to copy, reproduce, sell, rent, reverse engineer, adapt, disassemble, modify, distribute, or create derivative works from any part of the Website or its Materials.

    • You expressly confirm that You will not use, digitally alter, manipulate, exploit, or circulate any part of the Website or Materials in any unauthorised manner.

3. User Material

  • The Website may permit Users to post or upload content such as text, images, videos, audio, opinions, recommendations, or other materials (“User Material”). Such User Material reflects the views of the User alone and does not represent the views or endorsements of Agram Konnect.

  • By submitting User Material, You grant Agram Konnect a perpetual, worldwide, royalty-free, irrevocable, non-exclusive license to use, reproduce, modify, distribute, and publicly display the User Material in any media now known or developed in the future.

  • Agram Konnect reserves the right, but not the obligation, to monitor, remove, suspend, or alter any User Material at Our discretion, without liability or prior notice.

  • If any product reviews or similar content are posted, they reflect only the author’s opinion and not that of Agram Konnect.

    • By posting User Material, You represent and warrant that:

      • It is original and does not infringe on any third-party rights;

      • It is not defamatory, obscene, pornographic, abusive, illegal, or harmful to any person or group;

      • It complies with all applicable laws

    • You agree not to post any User Material that:

      • Belongs to others without permission;

      • Is harmful, offensive, defamatory, hateful, or unlawful;

      • Harms minors or infringes intellectual property rights;

      • Contains malware, viruses, or harmful code;

      • Threatens India’s sovereignty, security, or public order;

      • Is misleading, deceptive, or impersonates another person;

      • Violates any applicable laws or regulations

    • You further agree not to use the Website to:

      • Violate privacy or confidentiality rights;

      • Commit cyber terrorism or harassment;

      • Collect or misuse others’ personal information;

      • Upload unauthorised advertising, spam, or malicious content;

      • Interfere with the Website’s operations or user experience;

      • Remove or block advertisements or other users’ information;

      • Engage in any illegal or prohibited activities

    • Agram Konnect has the sole right to determine compliance with these rules, remove any content deemed inappropriate, and terminate access without prior notice.

    • By submitting User Material, You acknowledge that You waive ownership rights and accept the risks related to public posting, including unauthorised use or alteration by third parties. Agram Konnect is not responsible for any misuse by other Users.

    • Agram Konnect is not liable for any offensive, defamatory, or illegal conduct by other Users or any infringement of Your rights by others on the Website.

4. Disclaimer and Limitation of Liability

  • Your use of the Website is at Your own risk. By using the Website, You accept that You have read, understood, and agreed to this disclaimer.

  • Information provided on the Website is for general purposes only and should not be treated as professional advice. Laws and regulations can vary with circumstances, and delays or inaccuracies may occur. Agram Konnect and its affiliates are not liable for any decisions made based on this Website’s content.

5. Indemnity

6. Termination

  • You may also terminate Your use of the Website by ceasing to use it.

  • Sections relating to Intellectual Property, User Material, Disclaimer, Liability, Indemnity, and Governing Law will survive termination.

7. Governing Law and Dispute Resolution

  • These Terms of Use and Your use of the Website are governed by the laws of India.

  • Any disputes arising out of or relating to these Terms or Your use of the Website shall be subject to the exclusive jurisdiction of courts located in New Delhi, India.
